AN ORDINANCE PROVIDING FOR THE AMENDMENT OF ORDINANCE NO. 370 REGULATING MOBILE HOMES AND THE PLACEMENT THEREOF; APPLYING RESTRICTIONS AND LIMITATIONS FOR THE TOWN OF HOLLY, COLORADO
WHEREAS, as a matter of serving its residents, the Board of Trustees is desirous of preventing any resident from using certain permanent style propane tanks for their temporary recreational vehicle; and
WHEREAS, The Board of Trustees currently has an ordinance prohibiting permanent residence of any person within a travel trailer or recreational vehicle.
NOW, THEREFORE, BE IT ORDAINED by the Board of Trustees of the Town of Holly, Colorado as follows:
Section 1. It is unlawful for any person to use a recreational vehicle as a residence.
New sections of restrictions and limitations to be enacted are as follows:
Section 2. Definitions
a. Recreational Vehicle: For purposes of this Ordinance, “recreational vehicle” is defined as a vehicular unit, other than a mobile home or a manufactured home, whose gross floor area is less than 320 square feet (29.7 m²), which is designed as a temporary dwelling for travel, recreational and vacation use, and which is either self-propelled, mounted on or pulled by another vehicle. Examples include, but are not limited to, a travel trailer, truck camper, motor home, fifth-wheel trailer or van.
b. Permanent Residence: For purposes of this Ordinance, “residence” is defined as any place which is occupied by any persons, owners, family, tenants for a period in excess of seven calendar days in any one month.
Section 3. It shall be unlawful for any person to attach a propane tank to any recreational vehicle if the size of the propane tank exceeds the limitations set forth herein:
a. The maximum tank size allowed to be attached to and used in conjunction with any recreational vehicle in the Town of Holly shall be no greater than fifty (50) gallons per tank.
b. No recreational vehicles may have more than two (2) propane tanks attached at a time.
Section 4. The provisions of this Ordinance shall not apply to propane tanks of less than five (5) gallons of propane that are used for barbeque purposes.
Section 5. In the event that this Ordinance conflicts with any other provisions of the Municipal Code of the Town of Holly, or any provisions of any Uniform Code adopted by the Town of Holly, then the provisions of this Ordinance shall control.
The Board of Trustees hereby finds and declares that an emergency exists and that the public health, welfare, and safety require that this Ordinance shall be and become effective immediately after its final passage and publication.
