AN ORDINANCE AMENDING TOWN OF HOLLY ORDINANCE NO. 339 PERTAINING TO CANCELLATION OF THE TOWN OF HOLLY ELECTIONS IN THE EVENT THERE ARE NOT MORE CANDIDATES THAN POSITIONS TO BE FILLED AND TO PROVIDE FOR WRITE-IN CANDIDATES

WHEREAS, the Colorado State Statutes have been revised and the current town code requires amending accordingly, and

WHEREAS, the Town of Holly Board of Trustees requires an affidavit of intent for any write-in candidate for any Town election as provided in CRS 31-10-306; and

WHEREAS, no write-in vote for any municipal office shall be counted unless an affidavit of intent has been filed with the Clerk by the person whose name is written in, as provided in C.R.S. 31-10-306, the specified number of days prior to the election; and

WHEREAS, on election day the only matter before the voters is the election of candidates to office; and

WHEREAS, there are not more candidates than positions to be filled at such election including candidates filing affidavits of intent at the close of business on the specified day as provided in C.R.S. 31-10-507 per the specified number of days prior to the election.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF HOLLY THAT:

Section 1. The Town of Holly Board of Trustees shall cancel the election, upon completion of all C.R.S. election requirements.

Section 2. By resolution, shall declare the candidates elected.

Section 3. Upon each declaration the candidates shall be deemed elected.

Section 4. Notice of such cancellation shall be published and posted at each polling place and public notice locations.
