A RESOLUTION OF THE TOWN OF HOLLY, COLORADO TO ACCEPT AND APPROVE THE OFFICIAL APRIL 2, 2024 CANVASSED ELECTION RESULTS; TO SET FORTH THE IMPLEMENTATION OF THE 1% SALES TAX INCREASE TO THE TOWN OF HOLLY, TO BEGIN JANUARY 1, 2025 FOR THE PURPOSE OF PUBLIC SAFETY AS DEEMED BY THE TOWN OF HOLLY BOARD OF TRUSTEES

 

WHEREAS, the Town of Holly, Colorado (the "Town"), is a town duly organized and operating as a statutory town under the Constitution and laws of the State of Colorado (the “State”); and

 

WHEREAS, the Board of Trustees of the Town (“Board”) desired that there be established an additional sales tax of one percent (1%) sales tax to make the total four percent (4%) to provide revenue for the Town’s public safety; and

 

WHEREAS, in order to affect the proposed four percent (4%) sales tax the Board executed all necessary documentation and took whatever actions were reasonably required to effect said sales tax; and



WHEREAS, the effective date of this ballot issue, if passed by a majority of the qualified electors of the Town voting at the election on April 2, 2024, shall be on January 1, 2025; and

 

WHEREAS, Article X, Section 20 of the Constitution of the State of Colorado requires that the Town have voter approval in advance of the establishment of any tax; and

 

WHEREAS, a ballot issue, REFERENDUM 2A, was submitted on April 2, 2024 to the eligible electors of the Town authorizing the establishment of a one percent (1%) sales tax increase making the total sales tax to be four percent (4%) as stated below; and

REFERENDUM 2A

SHALL A SALES TAX BE ESTABLISHED FOR THE TOWN OF HOLLY, COLORADO, SUCH TAX TO CONSIST OF A TOWN-WIDE SALES TAX INCREASE OF 1% RESULTING IN AN ESTIMATED REVENUE TO BE $119,035.00, COMMENCING JANUARY 1, 2025; SHALL THERE BE APPROVED THE REFERRED ORDI-NANCE NO. 554 OF THE TOWN WHICH PROVIDES FOR THE 4% TOWN SALES TAX, PROVIDES FOR THE DEPOSIT OF TAX REVENUES INTO THE GENERAL FUND; AND SHALL ALL OF THE MONEY DEPOSITED IN THE GENERAL FUND CONSTITUTE A VOTER-APPROVED REVENUE CHANGE AND AN EXCEPTION TO THE REVENUE AND SPENDING LIMITS OF ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION?

 

WHEREAS, the ballot issue, REFERENDUM 2A, passed by a majority of the qualified electors of the Town of Holly with the canvass of the April 2, 2024 Election, completed on April 11, 2024.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of the Town of Holly:

Section 1. The April 2, 2024 election results for REFERENDUM 2A as being passed by a majority of the qualified electors of the Town be accepted.

Section 2. The sales tax for the Town of Holly will move from 3% to 4% on January 1, 2025.
